Similarly, all User Content is owned by the Users and protected under intellectual property rights, and may not be copied, imitated, or used without permission or license.
Therefore, except as stated elsewhere in these Terms, any use of intellectual property materials on this Site, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of AML is strictly prohibited.
12.1. Please Report Any Copyright Infringement
If you believe that any Content on the Site infringes these Terms, the rights of AML, your rights or the rights of a third party, or is otherwise unlawful, please send a written message to firstname.lastname@example.org. Please provide a detailed description and a location of the allegedly infringing material. Be aware that misrepresenting copyright infringement may cost you in fees and attorney expenses.
13. License for Non-Commercial Use of Content
AML authorizes you to view and make copies of images or other materials or Content on this Site for your non-commercial, personal use only. Note that this does not apply to any Content which AML offers as a Product which must be purchased. AML reserves all other rights. You agree that AML may display advertisements and promotions on the Site and within the Service or on, about, or in conjunction with your User Content. The manner and extent of such advertising and promotions may change without specific notice to you.
15. Choice of Law
AML, including the Site, is operated and provided in the State of Alaska. As such, we are subject to the laws of the State of Alaska. Alaska law will govern these Terms and any controversy arising through the use of the Site and our Services. We make no representation that our Site or other Services are appropriate, legal or available for use in
other locations. Accordingly, if you choose to access our Site you agree to do so subject to the laws, venue and jurisdiction of the State of Alaska.
16. Dispute Resolution
We would really like the opportunity to fix your experience with our Services any time you have an issue. With this in mind, you agree to notify AML in writing before pursuing any other resolution means by sending a written notice to the address below. Hopefully, we can resolve the issue to mutual satisfaction. Both parties will have 30 days to informally resolve the claim. We sincerely hope we can work things out and make you a satisfied customer once again.

If we cannot informally resolve our disputes, any controversy or claim arising out of or relating to the use of AML’s Site or Services or under these Terms must be settled by binding arbitration and not in a court of law. The arbitration will be handled by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes. The arbitration of disputes with AML will be binding, except as specified elsewhere in this agreement. If you reside in a country with laws that give consumers the right to bring disputes in their local courts, this paragraph doesn’t affect those requirements.
Waiver to Class Action
You agree that you may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed.
However, in which: (1) the dispute is filed as a class, collective, or representative action and (2) there is a final judicial determination that the Class Action Waiver is unenforceable as to any claims, then those claims shall be severed from any remaining claims and may be brought in a civil court of competent jurisdiction, but the Class Action Waiver shall be enforced in arbitration on an individual basis as to all other claims to the fullest extent possible.
If you desire to initiate arbitration you must provide us, the other party, with a written Demand for Arbitration as specified in the AAA Rules. (The AAA form Demand for Arbitration is available at www.adr.org or by calling the AAA at 1-800-778-7879). The Arbitrator will be either (1) a retired judge or (2) an attorney specifically licensed to practice law in the state of Alaska and will be selected by the parties from the AAA’s roster
of consumer dispute arbitrators. If the parties are unable to agree upon an Arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the Arbitrator in accordance with the AAA Rules.
Location and Procedure
Unless you and AML otherwise agree, the arbitration will be conducted in Anchorage County, Alaska. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of documents you and AML submit to the Arbitrator, unless you request a hearing or the Arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the Arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.
Filing fees are paid by are paid by the party that asserts the claim or counterclaim. Your responsibility to pay any AAA filing, administrative and arbitrator fees will be solely as set forth in the AAA Rules.
Exceptions to Agreement to Arbitrate
- Injunctive Relief for Intellectual Property Rights. Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services, or intellectual property infringement (for example, trademark, trade secret, copyright, or patent rights) without first engaging in arbitration or the informal dispute-resolution process described above. If the agreement to arbitrate is found not to apply to you or your claim, you agree to the exclusive jurisdiction of the state and federal courts in Anchorage County, Alaska to resolve your claim.
- Appeal Available for Errors in Law or Legal Reasoning. The arbitrators shall prepare in writing and provide to the parties an award including factual findings and the reasons on which their decision is based. The arbitrator’s decision may be appealable if it is based on errors of law or legal reasoning. The award is subject to review for legal error, confirmation, correction or cancellation in Alaska state court.
Changes to This Arbitration Agreement
If AML changes this Arbitration Section of the Agreement after the date you first agreed to the Terms (or to any subsequent changes to the Terms), you may reject any such change by providing AML written notice of such rejection within 30 days of the date such change became effective, as indicated in the “Effective” date above. This written notice must be provided by mail.

In order to be effective, the notice must include your full name and clearly indicate your intent to reject changes to this Arbitration Agreement. By rejecting changes, you are
agreeing that you will arbitrate any dispute between you and AML in accordance with the provisions of this Arbitration Agreement as of the date you first agreed to the Terms (or to any subsequent changes to the Terms).
Severability and Survival
If any portion of this Arbitration Section of the Terms of Service is found to be unenforceable or unlawful for any reason, (1) the unenforceable or unlawful provision shall be severed from these Terms; (2) severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of the Arbitration Section of this Agreement or the parties’ ability to compel arbitration of any remaining claims on an individual basis pursuant to the Arbitration Agreement; and (3) to the extent that any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration.
17. Compliance with Laws
User assumes all knowledge of applicable law and is responsible for compliance with any such laws. User may not use this Site or Services in any way that violates applicable state, federal, or international laws, regulations or other government requirements. User further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.
You agree that these Terms and any other agreements referenced herein may be assigned by AML, in our sole discretion, to a third party. These Terms shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a User.
19. Modification and Voided Terms
Modification. AML reserves the right, at any time, to modify, alter, or update these Terms and conditions without prior notice. Any modifications shall become effective upon the date of being posted on the Site. Any continued use of the Site after modifications are posted constitutes acceptance by the User(s).
We reserve the right to investigate any violation of these Terms, though we do not assume that obligation. Upon discovery of violation, we may remove, disable access to, or modify any User Content that violates these Terms.
